The US government is acting as the corporate lawyer for Big Tech (OpenAI, Google, Meta). Labs are bogged down in multi-billion dollar lawsuits from labels and publishers. If courts ban the scraping of raw data without licensing, the unit economics of LLM development will collapse—paying for every text or song is physically impossible. Pushing "fair use" at the G20 level is an attempt to legalize the expropriation of intellectual property to maintain Western technological superiority in the AI race. Datasets must be free, otherwise the industry will get stuck in courtrooms.
